Welcome to KB Software LLC. These Terms of Service ("Terms") govern your use of our website, products, and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By purchasing, downloading, installing, or using any KB Software LLC product or service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use our services.

2. Products and Services

KB Software LLC offers the following products:

• WinReady: A Windows utility for upgrading to Windows 11 on hardware that doesn't meet Microsoft's official requirements
• VeriSecure: A cybersecurity platform (coming soon)
• AffiliatesFlow: An affiliate management platform
• KianBot: An AI-powered development platform (enterprise/beta)

3. License Terms

3.1 License Grant

Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to use the software on a single device, subject to these Terms.

3.2 License Restrictions

You may NOT:

• Share, distribute, or resell your license key
• Use a single license on multiple devices simultaneously
• Reverse engineer, decompile, or disassemble the software
• Remove or modify any proprietary notices
• Use the software for any unlawful purpose
• Sublicense or transfer your license to another party

3.3 Hardware Binding

Licenses are bound to the hardware (device) on which they are first activated. Once activated, a license cannot be transferred to a different device. This is to prevent unauthorized sharing and piracy.

3.4 License Validation

Our software may periodically connect to our servers to validate your license. This requires an internet connection. Tampering with license validation may result in license revocation.

4. Purchases and Payments

4.1 Pricing

All prices are listed in US Dollars (USD) and are subject to change without notice. The price at the time of purchase will be honored.

4.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your payment card information.

4.3 Delivery

Upon successful payment, you will receive your license key and download link via email. Digital delivery is typically instant but may take up to 24 hours.

5. Refund Policy

We offer refunds under the following conditions:

• Technical Issues: If the software fails to function as described and we cannot resolve the issue, you may request a full refund within 30 days of purchase.
• No Questions Asked: You may request a refund within 7 days of purchase for any reason, provided the license has not been activated.
• Activated Licenses: Once a license is activated on a device, refunds are only available for documented technical issues we cannot resolve.

6. WinReady Specific Terms

• WinReady uses Microsoft's documented registry bypass method for unsupported hardware
• Microsoft may change policies regarding updates for unsupported hardware at any time
• We are an independent company and are NOT affiliated with or endorsed by Microsoft Corporation
• Windows 11 itself is free from Microsoft; you are paying for our upgrade assistance tool and support
• You are responsible for backing up your data before performing any upgrade
• While the upgrade process preserves files in most cases, we recommend a full backup

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our software is provided "AS IS" without warranties of any kind
• We do not warrant that the software will be error-free or uninterrupted
• We do not warrant compatibility with all hardware or software configurations
• We make no guarantees regarding Microsoft's future update policies

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• KB Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the product
• We are not responsible for data loss, system damage, or any other damages arising from use of our software

9. Indemnification

You agree to indemnify and hold harmless KB Software LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our products or violation of these Terms.

10. Intellectual Property

All software, documentation, trademarks, and other intellectual property are owned by KB Software LLC or our licensors. Your license does not grant ownership of any intellectual property.

11. Termination

We may terminate or suspend your license immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent activity
• License key sharing or piracy
• Chargebacks or payment disputes found to be fraudulent

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Palm Beach County, Florida.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on our website. Continued use of our services after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and KB Software LLC regarding the use of our products and services.
